General Terms and Conditions (hereinafter: GTC)

General:

These GTC of Reini Rossmann GmbH (hereinafter: Seller) apply to all contracts concluded between the Seller and its customers for the goods presented in the Seller’s online shop. Only consumers are considered customers under these GTC

A consumer, according to § 1 KSchG, is any natural person who enters into a transaction that is not part of their business activities.

By submitting their contract declaration, the customer accepts these GTC. Contracts are only possible under these conditions. Deviating terms and conditions must be expressly agreed upon in writing on a case-by-case basis.

For multiple, temporally separated contract conclusions, the version of the GTC published at the time the customer submits the contract declaration shall apply.

Important Safte Notice:

1. No Minors or Vulnerable Individuals: Our knives, tools and related products should never be entrusted to children, adolescents under the age of 18, or individuals with disabilities or mental impairments.
2. Avoid Self-Testing: Refrain from testing the sharpness of our knives and tools on yourself. Doing so can result in severe injuries, potentially fatal.
3. No Threats or Harmful Intentions: Under no circumstances should you use our knives or tools to threaten or harm others intentionally.
4. Proper Storage: When carrying our knives and tools always utilize the provided sheaths to prevent personal injuries in case of accidental falls.
5. Designed for Private Use: Our knives and tools are exclusively intended for private use, such as outdoor activities, holidays, barbecues, and leisure pursuits.
6. Handle with Care: It is crucial to exercise care and caution when handling our products to ensure the safety and well-being of all users.

Contract Conclusion:

By submitting an order, the customer makes a binding offer to the Seller. The products displayed on the Reini Rossmann GmbH websites or their descriptions do not constitute offers. The customer is merely invited to make a binding offer by clicking the "order with obligation to pay" button.

Upon receipt of the order, the customer will receive confirmation of the receipt of their order. This confirmation does not constitute acceptance of the offer. There shall be no contract between the Seller and the customer until the Seller has separately sent written confirmation to the customer that the latter's order has been accepted (the order confirmation). Order confirmations are sent separately within a reasonable period of no more than 5 working days.

In the event that communication with the customer regarding the placed order is necessary, this will be done via the email address provided by the customer. Emails sent by the Seller to the email address provided by the customer are considered delivered.

For the shipment of goods for which the law stipulates that they may only be sent to persons aged 18 or older, the customer is required to provide identification with proof of age in advance. The Seller will then ship the goods exclusively to the address provided by the customer.

Right of Withdrawal:

According to § 11 Distance and Off-Premises Contracts Act (hereinafter: FAGG), a consumer has the right to withdraw from a distance contract or a contract concluded outside business premises within 14 days without giving any reason. The withdrawal period begins for purchase contracts on the day the customer takes possession of the goods. In the case that the customer orders multiple goods as part of a single order, which are delivered separately, the withdrawal period starts on the day the customer takes possession of the last delivered goods. If goods are delivered in multiple partial shipments, the withdrawal period begins on the day the customer takes possession of the last partial shipment.

To exercise the right of withdrawal, the customer must send a clear statement (e.g., email, letter) to the Seller regarding their decision to withdraw from the contract. The withdrawal is not bound to a specific form, it only needs to be effectively communicated to the Seller.

In the event of withdrawal, the customer will receive a full refund, including delivery costs, without undue delay and no later than 14 days from the day the Seller receives the withdrawal notice. The refund will be made using the same payment method that the customer used for the transaction.

The Seller may withhold the refund until the goods are returned or until the customer has provided proof of return, whichever comes first.

The customer must return the goods without undue delay and no later than 14 days from the day they informed the Seller of their withdrawal. The customer is responsible for the cost of returning the goods in any case.

Prices:

Europe: All price information is inclusive of country-specific VAT.

International: Costs arising from international deliveries (fees, taxes, customs duties, transfer fees, exchange rates) are to be borne by the customer.

Delivery and shipping costs are displayed separately to customers before they submit their offer.

The purchase price is due immediately upon acceptance of the offer, regardless of the chosen payment method. The shipment of the goods will only take place after the Seller has received the purchase price.

Retention of Title:

The ordered goods remain the property of the Seller until the full payment of the purchase price and all associated costs and expenses.

Warranty:

For consumers, the statutory warranty provisions under §§ 922 ff ABGB and § 8 KSchG apply.

For the customer, this means that the right to warranty according to § 933 para 1 ABGB, in the case of movable goods, must be asserted within two years in court. The deadline starts from the day of delivery of the goods.

If the Seller requests the return of the goods and the goods are actually defective, the Seller will bear the costs of the return. Otherwise, any shipping costs are to be borne by the customer. Defective goods should only be returned at the explicit request of the Seller.

Liability:

The Seller is liable for damages in accordance with legal provisions, except for damages caused by slight negligence. This limitation of liability does not apply to damages resulting from injury to life, body, or health of individuals and claims under the Product Liability Act.

Copyright and Usage Rights:

All images and texts published on the Knives4.com - Reini Rossmann GmbH websites for presenting the goods are subject to the provisions of copyright law. Saving, sharing (for a fee or free of charge), and reproduction of images by customers of the mentioned websites are not permitted.

Vouchers:

Vouchers issued by the Seller for promotional purposes with a specified validity period and provided free of charge to the customer can only be redeemed in the online shop. The Seller reserves the right to limit the voucher to specific items. The validity of free vouchers can be revoked or changed by the Seller at any time.

Vouchers must be redeemed before completing the order process. Retroactive consideration is not possible.

Only one voucher can be redeemed per purchase. Any remaining balance will not be paid out by the Seller.

Data Protection:

Personal data provided by the customer in the course of the business relationship, such as (e.g., name, address, email, phone number, delivery address), will be stored by the Seller to process the order.

Personal data will not be disclosed to third parties. Consent can be revoked by the customer at any time.

In the event that the Seller uses a service provider in accordance with the legal provisions of §10 DSG 2000, the service provider must commit to complying with its obligations under §11 DSG beforehand. Neither the Seller nor any potential service providers will transmit data to third parties located outside the European Economic Area. The Seller commits to complying with data security measures (§14 DSG) and data confidentiality (§15 DSG).

Other General Provisions:

Austrian law applies.

The place of jurisdiction is St. Pölten.

The Seller is entitled to adapt these GTC to changed conditions and requirements. In the event of such a change, the new GTC will come into effect three months after publication on the relevant Reini Rossmann GmbH website.

If individual provisions of these GTC are ineffective, what is most closely aligned with the will of the contracting parties with regard to content and meaning of the effective provisions of these GTC shall apply in place of the ineffective provisions.
